When you use the Site Pusthaka or any partner site of Pusthaka, it is understood that the usage is subject to the notices, terms, and conditions set forth in this agreement (the “Agreement”). In addition, when you use any Pusthaka service (e.g., Customer Reviews), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they are incorporated into this Agreement by this reference. Pusthaka reserves the right to change these terms and conditions at any time. ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT, SO PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.

Use Of Site

You represent and warrant that you are at least 18 years old or visiting the Site under the supervision of a parent or guardian. Subject to the terms and conditions of this Agreement, Pusthaka hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use the Site by displaying it on your internet browser only for the purpose of shopping for personal items sold on the Site and not for any commercial use or use on behalf of any third party, except as explicitly permitted by Pusthaka in advance. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.

Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted by Pusthaka in writing. You may not make any commercial use of any of the information provided on the Site or make any use of the Site for the benefit of another business unless explicitly permitted by Pusthaka in advance. Pusthaka reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Pusthaka believes that customer conduct violates applicable law or is harmful to Pusthaka’s interests. You shall not upload to, distribute, or otherwise publish through this Site any Content, information, or other material that:

(a) violates or infringes copyrights, patents, trademarks, service marks, trade secrets, or proprietary rights;
(b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or gives rise to liability; or
(c) includes viruses, worms, Trojan horses, or harmful code.

Reviews And Comments

Anything submitted to the Site including ideas, reviews, comments, or suggestions (“Submissions”) shall be treated as non-confidential and non-proprietary. Pusthaka shall have royalty-free, worldwide, perpetual rights to use, copy, distribute, publish, display, and modify such Submissions.

All Submissions automatically become the property of Pusthaka.

You confirm you own rights to submitted content and that it does not violate third-party rights. Pusthaka may remove or edit submissions at its discretion.

Risk Of Loss; other Terms Of Sale

You acknowledge that Pusthaka is an online shopping platform enabling users to purchase listed products. Pusthaka acts only as a facilitator/intermediary and is not a party to transactions between Seller and Buyer.

Pusthaka shall not be responsible for disputes between Users or for actions of Vendors/Sellers.

Pusthaka does not sell products directly and disclaims warranties regarding quality, safety, merchantability, or legality of listed products.

All purchases are made at your own risk and judgment.

The contract of sale exists strictly between Seller and Buyer. Items are available only while stock lasts.

Pusthaka accepts no liability for errors or omissions.

All orders require approved payment methods and verification if necessary.

You must provide correct delivery details. Orders placed constitute a firm commitment to purchase.

Credit Card Details

You confirm that payment details provided are accurate and legally owned by you. Pusthaka will not share such information except when required by law or regulation.

Confirmation

Pusthaka is not required to mediate disputes between Buyers and Sellers.

You release and indemnify Pusthaka from liability arising from user actions.

Seller is responsible for invoicing, delivery, damages, and product accuracy.

Risk of loss transfers upon delivery to the carrier.

Termination and effect of termination

Pusthaka may terminate this Agreement or revoke access without prior notice. Upon termination, access rights and account credentials may be revoked immediately.

International access

This Site may be accessed outside India. Users accessing from other countries must comply with local laws.

Disclaimer and limitation of liability

The Site and products are provided by Pusthaka on an “AS IS” and best-effort basis. Pusthaka makes no warranties regarding operation, information accuracy, or product suitability.

Pusthaka shall not be liable for indirect or consequential damages. Total liability shall not exceed fees paid during the month preceding the claim.

Typographical errors

If a product is listed at an incorrect price due to error, Pusthaka may cancel the order and refund the charged amount.
